A $1.6 million Krispy Kreme legal settlement is drawing to a close. If you are among the tens of thousands who qualify, you may be eligible for a cash payment. But time is short.

The settlement was given preliminary court approval on March 5. Now, claim forms must be submitted online or postmarked by June 22, 2026. Then, on July 6, 2026, the court will grant final approval for the Krispy Kreme data breach settlement following a hearing, and compensation can begin to be distributed.

Who qualifies and what’s next? Here’s the latest.

The Krispy Kreme settlement

The data breach occurred in November 2024. The personal information of 161,676 current and former Krispy Kreme employees, including names, dates of birth, Social Security numbers, and financial data, was believed to have been stolen. Krispy Kreme denied liability or wrongdoing but agreed to the settlement.

Those impacted are eligible for up to a $3,500 reimbursement for documented losses, or a cash payment of $75, with no details of the personal impact of the data breach provided. Either of these amounts may change following a final court hearing on June 6, 2026. The two settlement options cannot be combined.

Documentation for reimbursement may include phone records, emails, and receipts.

Eligible settlement members will also receive credit monitoring services for one year without submitting a claim, which includes $1 million in identity theft insurance with no deductible.

Are you eligible for a settlement payment? Here are the qualifiers:

  • You received a notice indicating that the data breach may have impacted your private information.

  • You submit a claim form by June 22, 2026, to receive a cash payment (credit monitoring is automatic and requires no claim form).

  • You are not eligible if you are a director, officer, or agent of Krispy Kreme or its subsidiaries and affiliates, or part of a governmental entity.

The deadline and details

Claim forms must be submitted by June 22, 2026. Alternatively, you have until June 6, 2026, to exclude yourself from the settlement or object to the settlement altogether.

Here’s how it works:

  • Choose your cash benefit: File a claim for reimbursement of losses up to $3,500 (requires documentation such as telephone records, emails, or receipts), or file for a cash payment of $75 with no documentation required.

  • File online or by mail. Submit your claim online at krispykremedatasettlement.com. To file by mail: Send your completed claim form to Krispy Kreme Data Incident, Settlement Administrator, PO Box 2047, Portland, OR 97208-2047.

  • Class members were sent a postcard notice with a unique ID and PIN. If you did not receive a notice or have lost yours, contact the Settlement Administrator at info@KrispyKremeDataSettlement.com or 877-239-1879 for assistance.

  • Credit monitoring activation codes were provided by postcard notices sent to eligible members on March 25, 2026. If you did not receive one, contact the Settlement Administrator to obtain your code. Credit monitoring will activate after the settlement is finally approved.

Cash payments will be issued after the July 6, 2026, final approval hearing and any appeals are resolved.
