Dem lawmaker claims Hunter Biden is victim of ‘two-tiered’ justice system — but curiously avoids key detail

Rep. Dan Goldman (D-N.Y.) claimed Wednesday that Hunter Biden is the victim of a two-tiered justice system in the United States.

But testimony from IRS whistleblowers quickly dismantled that narrative.

What did Goldman say?

Ahead of a House Oversight Committee hearing, Goldman dismissed whistleblower claims that Justice Department officials interfered in the Hunter Biden investigation.

“There is actually no basis to say that this is somehow political interference or a weaponization, as [Republicans] say, of the Department of Justice,” Goldman claimed. “In fact, based on my experience, I’m shocked that Hunter Biden was even charged with these crimes.

“So the fact that he’s even taking a plea deal, in my mind, demonstrates a two-tiered system of justice against Hunter Biden,” he asserted.

Goldman, however, provided no evidence to back his claims.

On the contrary, two IRS whistleblowers who played key roles in the Hunter Biden investigation have testified under criminal penalty about alleged DOJ interference. Not only has U.S. Attorney David Weiss not explicitly denied some of the claims, but the whistleblowers allege there were witnesses to Weiss’ own admissions of interference.

Importantly, the New York Times has independently confirmed some of the allegations that Goldman claimed are fantasy.

What did the whistleblowers say?

The second IRS whistleblower — IRS special agent Joseph Ziegler, a gay Democrat — told Congress at that Oversight hearing that investigators recommended multiple felony charges against Hunter Biden that ultimately never came to fruition.

“In August of 2022, we had a phone call with all of the assigned prosecutors and they had said that all four of them were recommending the approval of felony and misdemeanor tax charges,” Ziegler said.

But, according to Ziegler, DOJ officials pressured Weiss not to move forward with felony charges because a jury may be sympathetic to Biden.

“David [Weiss] said to us … ‘I’m getting some concern from the Department of Justice Tax Division, the evidence that might come in related to his substance abuse and the death of his brother, Beau Biden, those might affect the jury’s opinion,'” Ziegler testified.

In sum, Ziegler testified that Weiss was “constantly hamstrung, limited, and marginalized by DOJ officials as well as other U.S. attorneys” and that investigators were prevented from investigating leads developed from the Biden probe that would have ensnarled other members of the Biden family.

Again, Whereas Goldman’s accusations were made from the comfort of MSNBC, Ziegler has repeatedly testified to these claims under criminal penalty.

Anything else?

In his MSNBC interview, Goldman did not address the gun charge against Hunter Biden.

Typically, violators of the gun law that Biden allegedly broke could face 10 years in prison. And typically, the DOJ prosecutes the crime to the fullest extent of the law. But in this case, Biden was offered pretrial diversion and a deal would save him from criminal prosecution. In fact, the charge will be dismissed if he fulfills the diversion requirements.

Earlier this year, the DOJ boasted about prosecuting the same crime for which Biden is charged. None of those alleged offenders were offered pretrial diversion. Goldman’s convenient avoidance of this fact is telling.
