An illegal alien admitted that he dismembered the body of a man who died in his apartment because he feared being deported, according to police.
The Phoenix Police Department said officers responded to a call of “unknown trouble” related to a foul odor emanating from two bags in an alley in Phoenix, Arizona, on June 28.
They discovered human remains in the bag from a dismembered body that they later identified as belonging to 34-year-old Jose Gutierrez.
Surveillance video led police to identify a suspect, and they were able to locate him at a nearby apartment complex.
Police arrested 30-year-old Carlos Guadalupe Leon Soto on July 18 and said that he had admitted under questioning to dismembering Gutierrez but claimed that he did not kill him.
Soto allegedly told police that he had met Gutierrez around June 19 as Soto was working at a Mexican food store. He said that he and Gutierrez slept in the same bed but denied that they were in a sexual relationship, according to police.
Court documents said that approximately three days later, Gutierrez died of an overdose at the apartment while Soto’s roommates were away for a few days.
Soto allegedly told police that he feared deportation so he “threw him away,” referring to Gutierrez.
Prosecutors say Soto admitted to dismembering Gutierrez’s body with a kitchen knife then flushing some of his body organs down a toilet before storing his severed body parts in plastic and garbage bags.
Investigators said that they found severed arms, legs, and the man’s lower torso inside of two trash bags. Soto also allegedly led investigators to the location of the severed head of the victim.
Soto is charged with three felonies: abandonment or concealment of a dead body, tampering with physical evidence, and hindering prosecution.
