A Washington state homeowner was stunned to find that a 24-year-old man was living in the attic of his property after he smelled cigarette smoke and noticed that he was missing some items in the house.

The unidentified homeowner called police on Monday after he followed the scent of the smoke and discovered signs of a person living in a loft area of a building on his property.

“They found a makeshift bed, clothes that didn’t belong to them, food that was halfway eaten, drug paraphernalia, a heater turned on upstairs,” police said in their report.

He also reported that he was missing about $3,000 along with his passport and a wallet with bank cards and a license.

Police removed the items in the attic and told the homeowner that whoever was living there would likely return.

Their prediction was correct.

On Tuesday, police were called after the homeowner said someone had locked him out of the building. When police responded, they found Daniel Tomoiaga inside the property with all of the items that he had allegedly stolen from the homeowner.

Police were able to arrest Tomoiaga after spending half an hour to get him out of the home and said they found fentanyl and meth on him.

He was booked into the Snohomish County Jail and charged with second-degree theft, residential burglary and knowingly possessing fentanyl and methamphetamine. He was given a $25,000 bail by a judge.

Police said Tomoiaga was well known to them and had a long criminal past, including nine felonies and misdemeanors. Among those was a charge for trespassing just two weeks prior to the newest incident. He was first charged as a ten-year-old for theft.
